What happened

The Bavarian DPA ("Bayrisches Landesamt für Datenschutzaufsicht" - BayLDA) held that the use of the newsletter tool Mailchimp by a German company was unlawful as Mailchimp receives email adresses of newsletter subscribers and might qualify as an "electronic communication service provider" under US surveillance law.
