What happened
The DPA held that a credit information agency violated the prohibition of automated individual decision-making (ADM) by calculating a data subject’s creditworthiness leading to an energy provider’s decision not to conclude a contract with the data subject. The energy provider’s rejection also constituted ADM but was considered necessary for entering into a contract.
